You can legally advertise on these cannabis marketing channels

Each channel has its own rules in this state. Pick one to jump straight to what is allowed.

TL;DR

The short version of what this state allows and prohibits.

Alaska requires every advertisement to carry the business name, the licence number and five warning statements, quoted word for word. It sets no general audience composition percentage. It prohibits advertising within 1,000 feet of a child centered facility and within 1,000 feet of a substance abuse or treatment facility, and prohibits placement on or in publicly owned or operated property. A separate outdoor advertising statute amounts to a statewide billboard ban.

Working with a partner that already knows these rules shortens the launch cycle. See how we run campaigns as a cannabis marketing agency in Alaska.

Alaska Cannabis Advertising Summary

Disclosure, audience, placement, out of home and mobile at a glance.

Disclosure
Business name and licence number under 3 AAC 306.770(c), and five warning statements under (g). Exemption at (d) for an advertisement containing only business name, logo, business type, contact information, location and hours, with no written information about marijuana and no photographic or illustrative depiction of marijuana.
Audience
21. Alaska sets no general audience composition percentage. The only percentage in the regulation is at (j): no more than 30 percent of an event's participants and audience reasonably expected to be under 21, for event sponsorship.
Placement
Under (f): 1,000 feet from the perimeter of a child centered facility, 1,000 feet from a substance abuse or treatment facility, and no placement on or in publicly owned or operated property.
Out of home
Third-party billboard inventory not available. AS 19.25.075 to 19.25.160 is a statewide outdoor advertising prohibition, and (f) bars publicly owned or operated property. Premises signage complying with local law is outside the definition of advertising under (b).
Mobile
Prohibited under (i) unless the marketing runs through a mobile device application installed on the device by an owner who is 21 or older, and the application includes a permanent and easy opt out.

Is Cannabis Advertising Legal in Alaska?

The short answer, and the conditions that come with it.

Verdict
Yes

Legal for licensed marijuana establishments, subject to the disclosure requirements at 3 AAC 306.770(c) and (g), the content prohibitions at (e) and (k), the placement prohibitions at (f), the web page age measure at (h), and the location-based device prohibition at (i). The requirements apply identically to medical and adult-use marketing.

Legal Framework and Compliance Basics

Which rules apply, who enforces them, and how current they are.

Advertising is governed by 3 AAC 306.770, administered by the Alcohol and Marijuana Control Office and the Marijuana Control Board. The regulation is organised by content and placement rather than by channel.

Medical and adult-use cannabis share one advertising rule set. Alaska runs both under one licensing framework and there is no separate advertising track for either.

Amendments effective October 8, 2023. The amendment at Register 248 repealed the premises signage caps, the postsecondary campus buffer, the numeric font sizing requirement for warnings, the prohibition on giveaway coupons, and the prohibition on promotional activities held off the licensed premises.

Physical outdoor advertising is governed by a separate statute. AS 19.25.075 to 19.25.160 is Alaska's outdoor advertising law.

View the source regulation, 3 AAC 306.770

Requirements That Apply to Every Channel

Business name and licence number

Required in every advertisement under 3 AAC 306.770(c).

The required warning statements

Five. All must appear under 3 AAC 306.770(g), quoted as codified:

  • "Marijuana has intoxicating effects and may be habit forming and addictive."
  • "Marijuana impairs concentration, coordination, and judgment. Do not operate a vehicle or machinery under its influence."
  • "There are health risks associated with consumption of marijuana."
  • "For use only by adults twenty-one and older. Keep out of the reach of children."
  • "Marijuana should not be used by women who are pregnant or breast feeding."

The regulation spells "twenty-one" in words and writes "breast feeding" as two words.

How the warnings have to appear

Visual contrast for print advertisements, intelligible audio for audio advertisements. The regulation prescribes no minimum font size. The former requirement that warnings appear in a font at least half the size of the advertisement's font and no smaller than nine point was repealed effective October 8, 2023. The former requirement that warnings play at the same speed as the advertisement was repealed on the same date.

When the warnings are not required

Under 3 AAC 306.770(d), an advertisement is exempt if it contains only the business name, logo, business type, contact information, location, and hours of operation, and contains no written information about marijuana or any photographic or illustrative depiction of marijuana, other than depictions within the established business name font and logo.

Hotline number

No. Alaska requires no hotline, helpline or poison control number in any advertisement. The five statements at (g) are the complete required set.

Prohibited content

Under 3 AAC 306.770(e), an advertisement may not contain any statement or illustration that:

  • Is false or misleading
  • Promotes excessive consumption
  • Represents that marijuana has curative or therapeutic effects
  • Depicts a person under 21 years of age consuming marijuana
  • Includes an object or character, including a toy or cartoon character, that appeals to a person under 21 years of age

Under (k), no games or competitions related to consumption, and no promotional materials or activities of a type especially appealing to children.

Discounts, coupons, and price promotion

Permitted. Alaska imposes no price advertising prohibition. The prohibition on giveaway coupons and the prohibition on promotional activities held off the licensed premises were both repealed effective October 8, 2023.

Under 3 AAC 306.355(a), a retail marijuana store may not sell one person per day more than one ounce of usable marijuana, seven grams of marijuana concentrate for inhalation, or 5,600 milligrams of THC in combined sales. The limits apply together and include product sold for onsite consumption.

Alaska Display Advertising Laws

Want to launch compliant display ads? Launch Now.

Alaska writes no display-specific rule. The universal content, disclosure and placement requirements govern in full.

What is allowed

Paid display, including programmatic. No provision of 3 AAC 306.770 prohibits digital display formats.

What is not allowed

  • Placement within 1,000 feet of the perimeter of a child centered facility or a substance abuse or treatment facility — (f)
  • Placement on or in publicly owned or operated property — (f)
  • Marketing directed towards location-based devices outside the installed-application exception — (i)
  • The content prohibitions at (e) and (k)

Required warnings and disclosures

Business name and licence number under (c), and all five warnings under (g), with visual contrast. See Requirements That Apply to Every Channel above.

Hotline number required

No.

Discounts and promotions on this channel

Permitted. Any offer remains subject to the daily purchase limits at 3 AAC 306.355(a).

Closing note

The disclosure set is the business name, the licence number and five warning statements. Size the creative to carry all of it, since the exemption at (d) is lost once an advertisement contains written information about marijuana. Compliance must sign off on how mobile display inventory is bought before launch, because (i) prohibits marketing directed towards location-based devices outside the installed-application exception.

Alaska Native Advertising Laws

Want to launch compliant native ads? Launch Now.

Alaska writes no native-specific rule. The disclosure requirements at (c) and (g) apply to an advertisement regardless of format.

What is allowed

Native and sponsored content carrying the full disclosure set. No provision of 3 AAC 306.770 prohibits native or sponsored formats.

What is not allowed

  • Any statement or illustration representing that marijuana has curative or therapeutic effects — (e)
  • Any statement or illustration that is false or misleading — (e)
  • Placement within the 1,000 foot buffers or on publicly owned or operated property — (f)
  • The remaining content prohibitions at (e) and (k)

Required warnings and disclosures

Discounts and promotions on this channel

Permitted, subject to the daily purchase limits at 3 AAC 306.355(a).

Alaska Online Video (OLV) Advertising Laws

Want to launch compliant online video ads? Launch Now.

Alaska writes no video-specific rule. Subsection (g) requires intelligible audio for audio advertisements and visual contrast for print advertisements.

What is allowed

Pre-roll, mid-roll and in-feed video. No provision of 3 AAC 306.770 prohibits video formats.

What is not allowed

  • Depicting a person under 21 years of age consuming marijuana — (e)
  • Including an object or character, including a toy or cartoon character, that appeals to a person under 21 — (e)
  • Placement within the 1,000 foot buffers or on publicly owned or operated property — (f)
  • Marketing directed towards location-based devices outside the installed-application exception — (i)
  • The remaining content prohibitions at (e) and (k)

Business name, licence number and all five warnings, delivered as intelligible audio or as on-screen text with visual contrast. The same-speed requirement was repealed effective October 8, 2023. See Requirements That Apply to Every Channel above.

Hotline number required

No.

Discounts and promotions on this channel

Permitted, subject to the daily purchase limits at 3 AAC 306.355(a).

Closing note

The numeric font sizing requirement was repealed on October 8, 2023 and replaced with a visual contrast standard. The regulation prescribes no minimum on-screen duration.

Alaska Connected TV (CTV) Advertising Laws

Want to launch compliant CTV ads? Launch Now.

Alaska writes no CTV-specific rule. The placement prohibitions at (f) are written by geography, which applies to household-level delivery as to any other placement.

What is allowed

CTV and OTT placements. No provision of 3 AAC 306.770 prohibits these channels, and the regulation sets no daypart restriction.

What is not allowed

  • Placement within 1,000 feet of the perimeter of a child centered facility or a substance abuse or treatment facility — (f)
  • Placement on or in publicly owned or operated property — (f)
  • The content prohibitions at (e) and (k)

Required warnings and disclosures

Business name, licence number and all five warnings, audible or on screen. See Requirements That Apply to Every Channel above.

Hotline number required

No.

Discounts and promotions on this channel

Permitted, subject to the daily purchase limits at 3 AAC 306.355(a).

Closing note

Alaska sets no audience composition percentage, so the regulation provides no threshold to buy against. Retain the composition data supplied by media partners, since the prohibitions at (e) and (f) apply regardless.

Want to launch compliant paid search? Launch Now.

Alaska writes no rule specific to paid search. Platform policy is the binding constraint rather than state law.

What is allowed

Search advertising under state law, carrying the full disclosure set. No provision of 3 AAC 306.770 prohibits paid search.

What is not allowed

  • The content prohibitions at (e) and (k)
  • Placement within the 1,000 foot buffers or on publicly owned or operated property — (f)

Required warnings and disclosures

Business name, licence number and all five warnings under (c) and (g). The regulation provides no exemption for character-limited formats. The exemption at (d) applies only where the advertisement contains no written information about marijuana. See Requirements That Apply to Every Channel above.

Hotline number required

No.

Discounts and promotions on this channel

Permitted under state law, subject to the daily purchase limits at 3 AAC 306.355(a).

Alaska SEO and Website Advertising Laws

Want to launch compliant SEO and website content? Launch Now.

Owned content carries the disclosure duty, and Alaska imposes a web page age measure that applies to no other channel.

What is allowed

A licensee's own website, menus and organic content. Under 3 AAC 306.770(h), a licensee advertising by means of a web page must use appropriate measures to ensure that visitors are 21 years of age or older.

What is not allowed

  • Advertising by means of a web page without appropriate measures to ensure visitors are 21 or older — (h)
  • The content prohibitions at (e) and (k)

Required warnings and disclosures

Business name, licence number and all five warnings on advertising content. The duty at (c) and (g) attaches to advertisements. See Requirements That Apply to Every Channel above.

Hotline number required

No.

Discounts and promotions on this channel

Permitted, subject to the daily purchase limits at 3 AAC 306.355(a).

Closing note

Subsection (h) requires appropriate measures and prescribes no mechanism. Record which measure is in use before launch, since the regulation places the obligation on the licensee.

Two separate bodies of law govern outdoor placement: the placement prohibitions at 3 AAC 306.770(f), and Alaska's outdoor advertising statute at AS 19.25.075 to 19.25.160.

What is allowed

Signage at the licensed premises complying with local law. Under 3 AAC 306.770(b), such signage is not advertising for the purposes of the section. Where there is no local government, (b) requires premises signs not to violate AS 19.25.075 to 19.25.160. A screen on private property outside the state highway right of way and outside both 1,000 foot buffers is not prohibited by (f).

What is not allowed

  • Placement on or in publicly owned or operated property — (f)
  • Placement within 1,000 feet of the perimeter of a child centered facility or a substance abuse or treatment facility — (f)
  • Outdoor advertising prohibited by AS 19.25.075 to 19.25.160
  • The content prohibitions at (e) and (k)

Required warnings and disclosures

Business name, licence number and all five warnings on any placement that is an advertisement. Premises signage within (b) is outside the definition and carries none of them. See Requirements That Apply to Every Channel above.

Hotline number required

No.

Discounts and promotions on this channel

Permitted where a placement is available, subject to the daily purchase limits at 3 AAC 306.355(a).

Closing note

Before committing spend, confirm that any proposed screen sits on private property, outside the state highway right of way, and outside both 1,000 foot buffers. Three separate provisions apply to the same site: (f) for the buffers, (f) for public property, and AS 19.25.075 to 19.25.160 for the outdoor advertising prohibition.

Platform Specific Advertising Restrictions

X (formerly Twitter)

Permits limited paid cannabis advertising in select U.S. jurisdictions subject to approval, licensing verification and 21-plus targeting.

Platform approval is not regulatory approval, and platform compliance does not protect against a state placement violation. Section 3 AAC 306.770(i) applies to marketing directed towards location-based devices, including cellular phones.

Audience Requirements for Cannabis Advertising in Alaska

Age thresholds, audience composition rules and age gating.

What the Law Requires

The age floor is 21. Under 3 AAC 306.770(e), an advertisement may not depict a person under 21 years of age consuming marijuana, and may not include an object or character, including a toy or cartoon character, that appeals to a person under 21 years of age. The regulation imposes no requirement to demonstrate a particular audience composition before placing media.

Audience Percentage Thresholds

Alaska sets no general audience composition percentage. This is an absence in the regulation rather than an omission from this page. Other states do set one: Connecticut requires reliable evidence that at least 90 percent of the audience is 21 or older, and California requires at least 71.6 percent. 3 AAC 306.770 sets no equivalent figure for any channel.

The one percentage in the regulation

Under 3 AAC 306.770(j), a licensed marijuana establishment may sponsor an industry trade show, charitable event, sports event or competition, concert, or other board-approved event as long as no more than 30 percent of the event's participants and audience is reasonably expected to be under 21 years of age. This figure applies to event sponsorship.

Where the burden sits

On the licensee. Subsection (j) requires that no more than 30 percent of the audience is reasonably expected to be under 21. The content prohibitions at (e) and the placement prohibitions at (f) apply to the licensee regardless of audience composition.

Age Gating and Consent

Websites

Under 3 AAC 306.770(h), a licensee advertising by means of a web page must use appropriate measures to ensure that visitors to the web page are 21 years of age or older. The regulation prescribes no mechanism.

Location-based devices

Under 3 AAC 306.770(i), marketing directed towards location-based devices, including but not limited to cellular phones, is prohibited unless the marketing is a mobile device application installed on the device by the owner of the device who is 21 years of age or older, and the application includes a permanent and easy opt out.

Established customers

3 AAC 306.770 contains no exception removing communications to existing customers or opted-in recipients from the definition of advertising.

People Depicted in Ads

Under 3 AAC 306.770(e), an advertisement may not depict a person under 21 years of age consuming marijuana, and may not include an object or character, including a toy or cartoon character, that appeals to a person under 21 years of age.

3 AAC 306.770 sets no minimum age for persons appearing in advertising, and contains no provision prohibiting the depiction of consumption by adults.

Geo Targeting Rules for Cannabis Advertising in Alaska

Buffer zones, local ordinances and how to geotarget compliantly.

Restricted Locations and Buffer Distances

The two 1,000 foot buffers

Under 3 AAC 306.770(f), no advertisement may be placed within 1,000 feet of the perimeter of any child centered facility, including a school, a child care facility or other facility providing services to children, a playground or recreation center, a public park, a library, or a game arcade admission to which is not restricted to persons 21 years of age or older. No advertisement may be placed within 1,000 feet of a substance abuse or treatment facility.

What the distance is measured from

The perimeter of the facility.

The exception

The child centered facility buffer does not apply where the advertisement is included in an established publication intended for general readership. The regulation does not define "established publication" and does not state whether a website falls within it.

Publicly Owned Property

Under 3 AAC 306.770(f), no advertisement may be placed on or in publicly owned or operated property. This prohibition is separate from the buffers and applies independently of them.

Can You Run a Digital Out of Home Screen in Alaska?

Alaska's outdoor advertising statute at AS 19.25.075 to 19.25.160 governs outdoor advertising. Section 3 AAC 306.770(f) prohibits placement on or in publicly owned or operated property and within both 1,000 foot buffers. A screen on private property, outside the state highway right of way and outside both buffers, is not prohibited by (f), and requires checking against all three provisions site by site.

The 500 Foot Buffer Is a Licensing Rule, Not an Advertising Rule

Under 3 AAC 306.010(a), the board will not issue a new marijuana establishment licence, or approve a transfer of licence location, if the licensed premises will be located within 500 feet of a school ground, a recreation or youth center, a building in which religious services are regularly conducted, or a correctional facility. This provision governs where a business may be located.

The two provisions differ in four respects:

  • Distance. The licensing rule uses 500 feet. The advertising rule at (f) uses 1,000 feet.
  • Measurement. The licensing rule is measured by the shortest pedestrian route from the public entrance of the building housing the licensed premises to the outer boundary or main public entrance of the protected site. The advertising rule is measured from the facility perimeter.
  • Protected facilities. The licensing rule covers buildings in which religious services are regularly conducted and correctional facilities. The advertising rule covers public parks, libraries, game arcades not restricted to 21 and over, and substance abuse or treatment facilities.
  • Subject. The licensing rule governs the location of licensed premises. The advertising rule governs the placement of an advertisement.

Compliant Use of Geotargeting

  • Build 1,000 foot exclusions around child centered facilities and around substance abuse and treatment facilities, measured from the facility perimeter, under (f).
  • Exclude publicly owned and operated property, including transit, under (f).
  • Use the 1,000 foot advertising figure at (f) rather than the 500 foot licensing figure at 3 AAC 306.010(a), and do not carry across the licensing rule's facility list or its pedestrian route measurement.
  • Have compliance sign off on how mobile display inventory is bought before launch. Subsection (i) prohibits marketing directed towards location-based devices outside the installed-application exception.
  • Confirm the age measure in use for any advertising web page, under (h).
  • For out of home, check each site against the buffers at (f), the public property prohibition at (f), and AS 19.25.075 to 19.25.160 before committing spend.

What Are the Recreational and Medical Marijuana Rules in Alaska?

How the rules differ between medical and adult-use licences.

One advertising rule set. Alaska applies 3 AAC 306.770 to every licensed marijuana establishment. The content restrictions, disclosure requirements, warning statements and placement buffers apply regardless of whether the establishment serves medical or adult-use customers.

What Are the Hemp and CBD Rules in Alaska?

Who regulates hemp and when cannabis advertising rules apply.

Who regulates hemp here

The Department of Natural Resources, Division of Agriculture, under 11 AAC Chapter 40, effective November 3, 2023. Not the Marijuana Control Board. Nothing in 3 AAC 306 governs hemp.

Non-intoxicating hemp and CBD

Permitted through registered growers and processors under the industrial hemp program.

Intoxicating hemp-derived cannabinoids

Not endorsed under the program. The Division's guidance lists delta-9 THC, delta-8 THC-O, delta-10 THC-O, delta-6 THC-O, THCA, THCV, THCP, HHC, HHCP and other synthetic or lab created cannabinoids derived from hemp as products that are not endorsed and may not be offered to consumers. The Division's regulations were challenged and upheld in 2025. The federal definition of hemp narrows in November 2026.

What it means for advertising

A product within the licensed marijuana channel is governed by 3 AAC 306.770 and carries the disclosure, content and placement requirements on this page. A non-intoxicating hemp product within the industrial hemp program is outside 3 AAC 306. The Division of Agriculture and AMCO share enforcement of Alaska's hemp laws.
